Wills, Powers of Attorney & Administration of Estates

Wills

It is important to organise your affairs and leave them in capable hands giving you and your family peace of mind. By making a Will ensures that family and friends are aware of your wishes and makes the process of dealing with matters more easily and straight forward.

Our experienced Wills and Probate team will provide specialist advice to be able to tailor your Will to your exact wishes.  The Will is drafted to ensure it is legally valid, signed correctly and safeguards from any misinterpretation.

Areas of expertise include:

  • Inheritance tax planning.
  • Capital Gains Tax planning.
  • Estate planning.
  • Creation and Restructuring of Trusts.
  • Asset protection.
  • Business planning.
  • Care home fee planning.

You also have the added reassurance of leaving your original Will in our dedicated strong room facility for safekeeping.

Powers of Attorney

We would encourage everyone to consider making a power of attorney.  This can take the form of a General Power of Attorney to deal with an immediate situation, or to plan for the future, a comprehensive and involved document such as Lasting Power of Attorney may be more appropriate.

A Lasting Power of Attorney is divided into two parts.  The first is in relation to property and financial affairs.  The second part is in relation to your health and welfare.

By having these documents in place and registered with the Office of the Public Guardian ensures that your attorneys are able to make specific decisions for you.

Our costs are usually fixed fee in relation to Lasting Powers of Attorney and includes drafting, ensuring the document is executed correctly and registering this with the Office of the Public Guardian.

Massers are happy to retain the original Lasting Power of Attorney in our dedicated strong room facility for safekeeping.

Massers will also assist anyone who created an Enduring Power of Attorney.  Although these documents were replaced by Lasting Powers of Attorney, they do remain a legal document if executed correctly.

An Enduring Power of Attorney will only allow the appointed person to make financial decisions on your behalf.

Probate and Administration of Estates

When a loved one passes away it can be a traumatic experience.

Massers are on hand to help you with the process of dealing with someone’s estate.  We are able to assist with initial steps, applying for a Grant of Probate, and dealing with the administration of an estate.  This can involve tasks such as ensuring that the relevant taxes are paid, collecting in assets and clearing and selling property.

Our Dispute Resolution team specialise in inheritance claims.  More details surrounding this can be found on that page.

We offer a free initial 30 minute consultation in order to provide you with further information about how we can assist you and an estimate of our charges.

If you believe we can be of any assistance please contact us on 0115 851 1666 or at law@massers.co.uk to make an appointment, or alternatively to discuss matters over the telephone.

Both of our offices have wheelchair access but should you be unable to attend either of our offices we can arrange a home visit. This would incur an additional charge which we would be happy to discuss with you before we call to see you.
